Welcome to pestafy.com ("Pestafy," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and platform for event management, including event creation, registration, and ticketing. By accessing or using Pestafy, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Use of Our Services

Pestafy provides a platform for users to create, promote, manage, and attend events. To use our services, you must:

  • Be at least 16 years old or have parental consent if under 16.
  • Provide accurate and complete information when creating an account or registering for events.
  • Comply with all applicable laws, regulations, and these Terms.
  • Not use our services for any unlawful, harmful, or unauthorized purposes, including spamming, fraud, or distributing malicious content.

2. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities conducted under your account, whether authorized or not.
  • Notifying us immediately at support@pestafy.com if you suspect unauthorized access to your account.

3. Event Creation and Management

If you use Pestafy to create or manage events, you agree to:

  • Provide accurate event details, including date, time, location, and ticket pricing.
  • Comply with all applicable laws and regulations related to event hosting, including obtaining necessary permits.
  • Honor ticket purchases and refunds as outlined in your event’s refund policy, which must be clearly communicated to attendees.
  • Not post content that is offensive, misleading, or violates third-party rights (e.g., copyrights or trademarks).

Pestafy reserves the right to remove or suspend events that violate these Terms or our policies.

4. Payments and Fees

Pestafy facilitates payments for event tickets through third-party payment processors. You agree to:

  • Pay any applicable fees for using our services, as outlined during event creation or ticket purchase.
  • Provide accurate payment information and authorize Pestafy and our payment processors to charge your payment method.
  • Understand that ticket purchases are subject to the event organizer’s refund policy, and Pestafy is not responsible for processing refunds unless explicitly stated.

5. User Content

You may submit content to Pestafy, such as event descriptions, reviews, or feedback ("User Content"). By submitting User Content, you:

  • Grant Pestafy a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with our services.
  • Represent that you own or have the necessary rights to submit the User Content and that it does not violate any laws or third-party rights.
  • Acknowledge that Pestafy may remove or modify User Content that violates these Terms or our policies.

6. Intellectual Property

All content, logos, trademarks, and software on Pestafy, excluding User Content, are owned by or licensed to Pestafy. You may not copy, modify, distribute, or reproduce our intellectual property without prior written consent.

7. Termination

We may suspend or terminate your access to Pestafy at our discretion, with or without notice, if you violate these Terms or engage in conduct that harms Pestafy, its users, or third parties. You may terminate your account at any time by contacting us at support@pestafy.com.

8. Limitation of Liability

To the fullest extent permitted by law, Pestafy and its affiliates, officers, and employees will not be liable for:

  • Any indirect, incidental, or consequential damages arising from your use of our services.
  • Issues related to events, including cancellations, safety, or quality, which are the responsibility of event organizers.
  • Loss of data, revenue, or opportunities resulting from service interruptions or errors.

Our services are provided "as is," and we do not guarantee uninterrupted or error-free operation.

9. Indemnification

You agree to indemnify and hold Pestafy harmless from any claims, damages, or losses arising from your use of our services, violation of these Terms, or infringement of third-party rights.

10. Governing Law and Dispute Resolution
